Art. 1. General provisions
These conditions are valid only between the company A&D s.r.l., with registered office in via G. Marconi 131, 80026 Casoria NA, Italy VAT number and C.F. 08943191216, hereinafter referred to as '' Exclusive Car Models '' and any person who makes online purchases on the website www.exclusivecarmodels.com hereinafter referred to as '' Customer ''. These conditions may be subject to changes and the date of publication of the same on the site is equivalent to the date of entry into force.
These conditions govern purchases made on the website www.exclusivecarmodels.com, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree n. 206/2005, amended by Legislative Decree. n. 21/2014 and by Legislative Decree. 70/2003 on electronic commerce.
Art. 2. Object of the contract
With these general conditions of sale, Exclusive Car Models sells and remotely purchases the tangible movable goods indicated and offered for sale on the website www.exclusivecarmodels.com. The contract is concluded exclusively through the internet, by accessing the customer at www.exclusivecarmodels.com and making a purchase order according to the procedure provided by the site.
The customer undertakes to read these general conditions of sale before proceeding with the confirmation of his order.
Art. 3. Conclusion and effectiveness of the contract
The sales contract is considered concluded with the sending by Exclusive Car Models to the Customer of an e-mail confirming the order. The e-mail contains the order number, the price of the goods purchased, the shipping costs.
The Customer undertakes to verify the correctness of the data contained in the above email and to promptly notify Exclusive Car Models of any corrections / changes to be made.
Exclusive Car Models undertakes to describe and present the items sold on the site in the best possible way. Nevertheless, some errors, inaccuracies or small differences between the product depicted on the site and the actual product may emerge. Furthermore, the photographs of the products presented on www.exclusivecarmodels.com do not constitute a contractual element, as they are to be considered only representative.
Art. 4. Availability of products
The availability of the products refers to the actual availability or of goods arriving at the moment in which the Customer places the order. However, this availability must be considered purely indicative as:
- the products could be sold to other customers before confirming the order, due to the simultaneous presence on the site of multiple users,
- an IT anomaly could occur such as to make a product available for purchase that in reality is not.
Even after sending the order confirmation e-mail sent by Exclusive Car Models, there may be cases of partial or total unavailability of the goods. In this case, the order will be automatically rectified with the elimination of the product or products not available and the Customer will be immediately informed by e-mail; with this e-mail the customer will also be informed of the methods and timing of reimbursement of any sums paid.
Art. 5. Preorder products
The preorder is a service created for the most demanding and loyal collectors. By completing a preorder you can guarantee a model car in limited edition before it is put on the market.
When the model is available, you will receive an email to finalize the purchase. Then it will be sufficient to access your private area and complete the order by paying the difference to receive the model car.
In case of non-receipt of the balance payment within 7 days of receiving the first email notifying the availability of the model car, the preorder is canceled and does not provide for the refund of the payment.
Preorder model cars can have a delivery date ranging from 1 to 30 months.
The preorder cannot be cancelled, modified, refunded or transferred, even if you change your mind.
By continuing with the preorder payment, you accept the terms and conditions of sale.
Art. 6. Methods of payment
Credit card
You can pay for purchases with Visa, Visa Electron, MasterCard, Maestro, American Express, Discover, Aura credit cards registered in the PayPal circuit.
All transactions are guaranteed with maximum security on purchases as they are managed through secure servers and certified by PayPal.
Under no circumstances ExclusiveCarModels.com will be aware of the credit card number, nor will it process or store the data provided on its systems but will only receive communication of the outcome of the transaction.
PayPal
You can pay for purchases with PayPal, choosing whether to register or proceed to payment without registering.
The transaction is hosted by PayPal servers and is protected through the SSL (Secure Socket Layer) protocol.
At the time of entering the data relating to your credit card, the financial information is managed directly from the PayPal site.
PayPal Later
You can pay for purchases with PayPal, in three installments without interest and additional costs.
Wire transfer
You can pay for purchases with bank transfer.

Items are reserved when ordering and shipped as soon as payment is cleared.
The order is automatically canceled if payment is not received within 7 working days.
Art. 7. Prices
The prices of the items are those indicated on our website www.exclusivecarmodels.com.
The items used are VAT free for both EU and non-EU countries.
Shipping costs are not included in the purchase price, but are indicated and calculated at the conclusion of the purchase process before finalizing the payment.
The Customer accepts Exclusive Car Models' right to change his prices at any time, however the goods will be invoiced on the basis of the prices indicated on the site at the time the order is created and indicated in the confirmation email sent by Exclusive Car Models to the Customer.
Art. 8. Legal guarantee of conformity
In case of receipt of defective products or in any case non-compliant with the orders placed, the Customer has the right to replace the product. The Customer can exercise this right only on new models and within fifteen days of receipt of the same.
Exclusive Car Models, in the event of a defective or non-compliant product, will arrange, at its own expense, to organize the collection of the product, compatibly with the availability of the Customer.
Art. 9. Delivery methods
The package is generally shipped within 1-2 business days after receipt of payment.
In the case of orders for incoming items, the shipment will be made within 3-4 days from the arrival at our warehouse of the pre-ordered news.
Shipments may be slightly delayed during sales, promotions, events, national holidays, Christmas and Easter holidays.
Shipping costs are charged to the buyer and are explicitly highlighted at the time the order is placed.

Art. 10. Shipping insurance
To activate the shipping insurance, the customer must select the appropriate option with surcharge on the checkout page.
Without insurance, the customer cannot obtain a refund in case of loss or damage to the package.
Upon delivery by the courier, it is the customer's responsibility to verify that the packaging is not damaged or tampered with.
In this case he must specify it in writing in the carrier's delivery document by adding the wording "I accept with reserve" indicating the visible signs of damage or manipulation.
Omitting this procedure, the customer will not be able to claim damages.
In case of damage to the content alone, since it is fragile goods, no refund will be granted.
Art. 11. Withdrawal
The withdrawal can only be exercised by customers residing in Italy by sending a written communication to the email address info@exclusivecarmodels.com within fourteen (14) days.
Shipping costs are entirely charged to the customer.
The refund will be made with the same payment methods with which the order was placed, as soon as the perfect integrity of the goods is certified.
Art. 12. Liability
Exclusive Car Models assumes no responsibility for disservices attributable to force majeure or unforeseeable circumstances, even if dependent on malfunctions and disservices of the internet, in the event that it fails to execute the order within the time stipulated in the contract.
Art. 13. Access to the site
The Customer has the right to access the website for consultation and finalization of purchases. No other use, in particular commercial, of the site or its content is permitted. The integrity of the elements of this website and the related technology used remain the property of Exclusive Car Models and are protected by intellectual property rights.
Art. 14. Applicable law and competent court
These General Conditions of Sale are subject to Italian law.
Any dispute that does not find an amicable solution will be submitted to the exclusive jurisdiction of the Court of Naples, Italy.
In any case, it is possible to optionally resort to the mediation procedures referred to in Legislative Decree 28/2010, for the resolution of any disputes arising in the interpretation and execution of these conditions of sale by accessing the following site: https://ec.europa.eu/consumers/odr/.
