1. General provisions
These conditions are valid only between the company A&D s.r.l., with registered office in via G. Marconi 131, 80026 Casoria NA, Italy VAT number and C.F. 08943191216, hereinafter referred to as '' Exclusive Car Models '' and any person who makes online purchases on the website www.exclusivecarmodels.com hereinafter referred to as ''Customer''. These conditions may be subject to changes and the date of publication of the same on the site is equivalent to the date of entry into force.
These conditions govern purchases made on the website www.exclusivecarmodels.com, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree n. 206/2005, amended by Legislative Decree. n. 21/2014 and by Legislative Decree. 70/2003 on electronic commerce.
2. Object of the contract
With these general conditions of sale, Exclusive Car Models sells and remotely purchases the tangible movable goods indicated and offered for sale on the website www.exclusivecarmodels.com. The contract is concluded exclusively through the internet, by accessing the customer at www.exclusivecarmodels.com and making a purchase order according to the procedure provided by the site.
The customer undertakes to read these general conditions of sale before proceeding with the confirmation of his order.
3. Conclusion and effectiveness of the contract
The sales contract is considered concluded with the sending by Exclusive Car Models to the Customer of an email confirming the order. The email contains the order number, the price of the purchased or preordered products, and the shipping costs.
The Customer undertakes to verify the correctness of the data contained in the above email and to promptly notify Exclusive Car Models of any corrections / changes to be made.
Exclusive Car Models undertakes to describe and present the items sold on the site in the best possible way. Nevertheless, some errors, inaccuracies or small differences between the product depicted on the site and the actual product may emerge. Furthermore, the photographs of the products presented on www.exclusivecarmodels.com do not constitute a contractual element, as they are to be considered only representative.
4. Availability of products
The availability of the products refers to the actual availability or of goods arriving at the moment in which the Customer places the order. However, this availability must be considered purely indicative as:
- the products could be sold to other customers before confirming the order, due to the simultaneous presence on the site of multiple users,
- an IT anomaly could occur such as to make a product available for purchase that in reality is not.
Even after sending the order confirmation email sent by Exclusive Car Models, there may be cases of partial or total unavailability of the goods. In this case, the order will be automatically rectified with the elimination of the product or products not available and the Customer will be immediately informed by e-mail; with this email the customer will also be informed of the methods and timing of reimbursement of any sums paid.
5. Preorder products
Preorder is a service created for discerning collectors who can guarantee a product while it is in production by the manufacturer. Since many are produced in limited quantities, they may already be sold out before their release.
When the preordered product is available for shipment, the Customer will receive an email to finalize the purchase. They will need to log in to their reserved area and complete the order, paying the difference to receive the model.
If the balance payment is not received within seven (7) days of receiving the first email notifying the product of its availability, the pre-order will be cancelled and will not be refunded.
Preorder products may have a delivery date ranging from one (1) to thirty (30) months.
The preorder cannot be cancelled, modified, refunded, or transferred, even in the event of a change of heart.
The preorder obliges the Customer to pay the balance as soon as the product is available for shipment.
By proceeding with the preorder payment, the Customer accepts the terms and conditions of sale.
6. Methods of payment
You can pay for purchases on Exclusive Car Models with the following cards and payment platforms: Visa, MasterCard, American Express, Discover, Revolut, Amazon Pay, Apple Pay, Google Pay, Link, Bancontact, Cartes Bancaries, Eps, Ideal, Jcb, Klarna, Satispay.
7. Prices
The prices of the products are those indicated on our website www.exclusivecarmodels.com.
The items used are VAT free for both EU and non-EU countries.
Shipping costs are not included in the purchase price, but are indicated and calculated at the conclusion of the purchase process before finalizing the payment.
The Customer accepts Exclusive Car Models' right to change his prices at any time, however the goods will be invoiced on the basis of the prices indicated on the site at the time the order is created and indicated in the confirmation email sent by Exclusive Car Models to the Customer.
8. Delivery methods
The package is generally shipped within three-four (3-4 days) business days after receipt of payment.
In the case of orders for incoming items, the shipment will be made within three-four (3-4 days) from the arrival at our warehouse of the pre-ordered news.
Shipments may be slightly delayed during sales, promotions, events, national holidays, Christmas and Easter holidays.
Shipping costs are charged to the buyer and are explicitly highlighted at the time the order is placed.

9. Shipping insurance
To activate the shipping insurance, the customer must select the appropriate option with surcharge on the checkout page.
Without insurance, the customer cannot obtain a refund in case of loss or damage to the package.
Upon delivery by the courier, it is the customer's responsibility to verify that the packaging is not damaged or tampered with.
In this case he must specify it in writing in the carrier's delivery document by adding the wording "I accept with reserve" indicating the visible signs of damage or manipulation.
Omitting this procedure, the customer will not be able to claim damages.
In case of damage to the content alone, since it is fragile goods, no refund will be granted.
10. Returns
Returns may only be exercised by customers residing in Italy by sending written notification within seven (7) days to info@exclusivecarmodels.com.
Shipping costs are the sole responsibility of the customer.
To be accepted, returns must meet the following conditions:
- the product must be returned in the same condition in which it was delivered;
- the product must be returned in its original packaging;
- the product must be returned with the warranty certificate and all accessories included in the packaging;
- the product must be returned with the original warranty seals, which must not have been removed;
- the product must not show signs of use or damage.
Exclusive Car Models reserves the right to refuse the return or apply a reduction in the refund if the product shows signs of use or damage.
11. Refund
Once the returned product has been received and verified, Exclusive Car Models will process the refund within seven (7) days.
The refund will be made using the same payment method used for the purchase.
Exclusive Car Models may withhold the refund until the returned product is received.
12. Access to the site
The Customer has the right to access the website for consultation and finalization of purchases. No other use, in particular commercial, of the site or its content is permitted. The integrity of the elements of this website and the related technology used remain the property of Exclusive Car Models and are protected by intellectual property rights.
13. Applicable law and competent court
These General Conditions of Sale are subject to Italian law.
Any dispute that does not find an amicable solution will be submitted to the exclusive jurisdiction of the Court of Naples, Italy.
In any case, it is possible to optionally resort to the mediation procedures referred to in Legislative Decree 28/2010, for the resolution of any disputes arising in the interpretation and execution of these conditions of sale by accessing the following site: https://ec.europa.eu/consumers/odr/.
